These Terms of Service ("Terms") govern your use of thewaldrepcompany.com, our online courses, live cohorts, and consulting services. By using this site or purchasing a product, you agree to these Terms. If you do not agree, do not use the site or purchase a product.

1. Who We Are

The Waldrep Company is a digital forensics consulting and training firm based in the United States. "We," "us," and "our" refer to The Waldrep Company. "You" refers to the individual or organization accessing this site or purchasing a product.

2. Eligibility

Our website and courses are directed to professionals. You must be at least 18 years old to purchase a course or service. By purchasing, you represent that you are at least 18 years old and have the legal capacity to enter into a binding contract.

3. Account Registration

To enroll in an online course you must create an account. You agree to provide accurate, current information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at info@thewaldrepcompany.com if you suspect unauthorized use.

4. Course Access and License

When you purchase a course, we grant you a non-transferable, non-exclusive, revocable license to access the course content for personal professional development. Unless otherwise stated on the course page:

Agency licensing for multi-seat or department-wide deployment is available under a separate written agreement. Contact us to discuss.

5. Payment and Pricing

Prices are displayed in U.S. Dollars and processed by Stripe, our payment processor. You agree to pay all fees disclosed at checkout. We may change prices at any time, but the price at the time of your purchase applies to that purchase. Government purchase orders and net-30 invoicing are accepted for agency clients; contact us to arrange.

6. Refunds

Refund terms are set out in our Refund Policy. Self-paced online courses are covered by a 7-day satisfaction guarantee. Live cohorts, agency licensing, and downloadable resources have separate terms. The Refund Policy is incorporated into these Terms by reference.

7. Educational Use Only — Not Legal Advice, Not Certification

All courses, templates, articles, podcasts, and other content published by The Waldrep Company are provided for educational and informational purposes only. They are not, and shall not be construed as:

Certificates of Completion issued by The Waldrep Company evidence that the holder completed the course curriculum. They are not licenses, accreditations, or guarantees of any kind.

8. Lawful Use

Our courses teach techniques used in digital forensic investigation. You are responsible for ensuring that your application of these techniques complies with all applicable laws, including the Computer Fraud and Abuse Act, the Electronic Communications Privacy Act, the Stored Communications Act, the Wiretap Act, state computer crime statutes, GDPR and other privacy laws, applicable court rules, and the policies of your employer or agency. We do not authorize, and you agree not to use our materials to engage in, unauthorized access to computers, devices, accounts, or data.

9. Intellectual Property

All content on thewaldrepcompany.com — including course videos, lesson text, quizzes, templates, articles, branding, the Waldrep shield logo, and the CaseProof brand — is owned by The Waldrep Company or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, redistribute, scrape, mirror, or create derivative works without our written permission, except as expressly permitted in Section 4.

Third-party trademarks referenced on this site — including but not limited to Cellebrite, Magnet, AXIOM, GrayKey, Autopsy, FTK, X-Ways, and DJI — are the property of their respective owners and are used for identification and educational reference only.

Violations may result in suspension or termination of your account, forfeiture of course access, and where appropriate, referral to law enforcement.

11. Third-Party Services

We use third-party providers to operate the site and deliver our courses, including Stripe (payments), Supabase (authentication and course data), Netlify (hosting), Formspree (contact forms), Google Analytics (analytics), and Meta (advertising pixel). Your use of those features is also subject to those providers' terms and privacy policies. We are not responsible for the practices of third-party services.

12. Disclaimers

The site and all content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise. To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment. We do not warrant that the site will be uninterrupted, error-free, secure, or that defects will be corrected.

13. Limitation of Liability

To the maximum extent permitted by law, The Waldrep Company and its principals, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising from your use of the site or any course, even if advised of the possibility of such damages.

Our total cumulative liability for any claim arising from your use of the site or a course will not exceed the amount you paid us for the course or product that is the subject of the claim in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless The Waldrep Company and its principals, employees, contractors, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising from (a) your use of the site or any course, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) your application of course material in your own work.

15. Termination

We may suspend or terminate your account and access to courses at any time for violation of these Terms, fraud, chargeback, or other conduct we determine in good faith to be harmful. Sections 7 through 14, 16, and 17 survive termination.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the site will be brought exclusively in the state or federal courts located in Mobile County, Alabama, and you consent to the personal jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. The terms in effect on the date of your purchase apply to that purchase. For ongoing site use, continued use after a change constitutes acceptance of the updated Terms. Updates will be reflected by the "Last Updated" date at the top of this page.

18. Miscellaneous

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and The Waldrep Company regarding your use of the site and any course. If any provision is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our written consent; we may assign them to a successor in connection with a business transfer.
